The two Binays were accused regarding the graft and malversation for the misconduct in the P2.28 Billion construction of Makati City Hall Building II. The anti-graft court’s Third Division addressed the Bureau of Immigration (BI) to bar the elder Binay and son, on July 15.

Not only Binays yet the 17 other former Makati City officials related with them were banned in leaving the Philippines after the charges issued against them with graft and malversation by the office of the Ombudsman, the order was issued by Presiding Justice Amparo Cabotaje-Tang together with Associate Justices Samuel Martires and Sarah Jane Fernandez.

The hold departure order would be put in effect as soon as they receive the copy, BI spokesperson Antonette Mangrobang said.

“We need to get copy. We are just waiting for the official transmittal of the orders to us,” Mangrobang added.

The P2.28 Billion construction of Makati City Hall Building II begun in 2007 when elder Binay was still the mayor of Makati City, later during the term of his son Jun-Jun as Mayor it was completed in 2013. The case all begun after his son later was dismissed as Makati mayor by the Ombudsman and disqualified from holding public office because of the charges against him.

Binays' lawyer, Daniel Subido said “A hold-departure order is a necessary consequence of the mere filing of an information in the Sandiganbayan. It is applicable to all”.

“However, it has no bearing at all on the merits of the case. We are confident that these frivolous cases will be dismissed,” Subido added.

Last Friday, July 15, the two Binays already posted bail for their temporary freedom only few hours after the case was brought to the Sandiganbayan Third Division and before their warrants of arrest issued to them.
